Effective Date: June 2024. Welcome to SidmiAI Health. Please read these Terms of Service carefully before accessing our clinical AI platform.
1. Acceptance of Terms
By accessing or using the SidmiAI Health platform, clinical documentation services, APIs, and associated software, you agree to be bound by these Terms of Service. If you are entering into these Terms on behalf of an enterprise health system, hospital, or clinic, you represent that you have the legal authority to bind that entity.
2. Enterprise Licensing & Access
SidmiAI Health grants you a limited, non-exclusive, non-transferable, revocable license to access and use our clinical AI documentation platform for your internal professional healthcare operations. Access is contingent upon active subscription status and compliance with all applicable healthcare regulations.
3. Professional Healthcare Responsibility
SidmiAI Health is an artificial intelligence clinical documentation assistant designed to support healthcare providers. Our software does NOT provide medical advice, diagnosis, or treatment. The treating clinician maintains absolute independent professional medical judgment and is solely responsible for verifying the accuracy of all generated SOAP notes, billing codes, and clinical summaries before finalizing records in the EHR.
4. HIPAA Compliance & BAA
All processing of Protected Health Information (PHI) is governed by our separate Business Associate Agreement (BAA). Both parties agree to maintain strict compliance with HIPAA, HITECH, and applicable state privacy laws.
5. Service Availability & Support
We strive for 99.9% uptime for core clinical documentation services. Enterprise support is provided in accordance with your specific Service Level Agreement (SLA). Scheduled maintenance will be communicated in advance via our enterprise status portal.
6. Limitation of Liability
To the maximum extent permitted by applicable law, SidmiAI Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the platform.
7. Governing Law & Contact
